NYSIR Amends School Coverage to Provide Enhanced Protection in Wake of New DHR Law

The New York Schools Insurance Reciprocal (NYSIR) has changed its School Board Legal Liability Policy (SBL) language to address a possible coverage deficiency arising in connection with recent legislation that gives the state Division of Human Rights (DHR) the ability to investigate bullying, harassment and other forms of discrimination against students in public schools.


According to NYSIR officials, effective in October, the insurer’s SBL policy was amended to confirm that mental anguish and emotional distress related to a student’s alleged claim of harassment is not necessarily excluded from coverage. The change was initiated in light of the DHR’s expanded role in hearing cases and awarding damages for claims that in the past had usually been presented in a different court setting.
